Was There Sufficient Deliberation Before the Abolition of the Prosecutors’ Office?
Reorganizing government institutions does not necessarily produce immediate results.
What matters is whether the changes improve the efficiency of criminal proceedings, provide better protection for victims, and strengthen public trust in the justice system. If these improvements are achieved, the restructuring will have delivered meaningful results.
But was the abolition of South Korea’s Prosecutors’ Office based on sufficient consideration of these goals?
Distributing prosecutorial powers can be a legitimate policy objective. However, distributing power and abolishing an existing institution are not the same thing.
Abolishing one government institution and creating new ones requires careful consideration. We must examine what problems need to be resolved, whether organizational restructuring is the most appropriate solution, and what difficulties the new system might create.
Of course, if the existing prosecution system has problems, it should be reformed. If prosecutorial powers have infringed upon citizens’ rights or operated without adequate oversight, appropriate reforms are necessary.
However, the existence of problems within an institution does not automatically mean that abolishing it is the best solution.
Political reform should not be aimed simply at weakening or eliminating a particular institution. What matters is how the changes affect citizens’ lives and rights, as well as public confidence in the justice system.
The question I want to raise today is not whether the abolition of the Prosecutors’ Office was ultimately right or wrong.
Before making such a fundamental change to the government’s organizational structure, was there sufficient political judgment regarding its necessity, possible alternatives, expected benefits, and potential drawbacks?
Institutional reform should not end with the redistribution of power. It must ultimately lead to institutions that function better for the citizens they serve.
